Quick answer
Article 32 allows a person to approach the Supreme Court to enforce fundamental rights. Article 226 empowers High Courts to enforce fundamental rights and other legal rights. Writ relief depends on the facts, jurisdiction and available remedies. Choosing the correct court and requesting a specific, evidence-supported order are essential first steps.
What is the remedy under Article 32?
Article 32 guarantees the right to move the Supreme Court through appropriate proceedings for enforcement of rights conferred by Part III. It authorises directions, orders and writs suitable for that purpose. Its constitutional importance does not mean every legal disagreement belongs directly in the Supreme Court. The petition must establish a genuine fundamental rights issue and explain the relief sought.
A contractual payment dispute, an ordinary property disagreement or an unfavourable administrative order does not become an Article 32 matter simply because the petition mentions dignity or equality. Identify the protected right and the State action or other relevant constitutional violation. The Supreme Court may consider whether approaching the High Court is more appropriate in the circumstances. A careful forum assessment protects time and resources and helps avoid a petition that is dismissed without examination of the practical problem the applicant actually needs resolved.
How is Article 226 wider than Article 32?
Article 226 empowers High Courts to issue writs for enforcement of fundamental rights and for any other purpose within its legal scope. This makes it wider in subject matter than Article 32, which concerns Part III rights. A High Court may review breach of a public legal duty even when the case does not establish a separate fundamental rights violation.
Wider subject matter does not remove jurisdictional limits. Territorial connection, the nature of the respondent, the duty involved and the appropriateness of writ review remain important. Article 226 can reach a body performing a public duty in suitable circumstances without making every private contract enforceable by writ. The High Court is often the practical first constitutional forum for local administration, admissions and public employment disputes. Tell the adviser where the decision was made and where material events occurred, rather than assuming that your preferred city determines which court can hear the matter.

What does a habeas corpus petition ask for?
Habeas corpus addresses unlawful detention or confinement. A court can require the detained person to be produced and examine whether continued confinement has lawful authority. It can be relevant where officials deny holding someone or where a private person unlawfully confines another. A concerned relative or other suitable applicant may seek relief where the detained person cannot approach the court personally.
Provide the person’s identity, last known location, detention circumstances and the basis for suspecting confinement. Distinguish known facts from inference. Where detention rests on a competent court’s remand order, the ordinary remedy may involve challenging that order, seeking bail or using another appropriate procedure; habeas corpus is not a universal substitute. In adult relationship cases, the court’s concern is the individual’s freedom and wishes, not a relative’s claim to control their choices. Immediate safety and reliable information matter more than dramatic allegations unsupported by the available record.
When can a court issue mandamus?
Mandamus generally directs performance of a public or legally enforceable duty. An applicant ordinarily needs to show a corresponding entitlement and an authority’s failure to act as law requires. It does not allow a court to command an official to exercise a power the law does not confer. Nor will every unanswered private request create a public duty enforceable by writ.
A useful application identifies the statute, rule or other source of duty, the request already made and the response or unreasonable failure to respond. Where discretion exists, the court may require a lawful decision rather than dictate a particular outcome. For example, a direction to consider an application under governing criteria is different from an unconditional order to grant a licence. Keep the complete application, receipt, missing-document notices and replies. If urgency requires immediate intervention, explain why waiting for ordinary administrative processing would defeat the protected interest.
How do certiorari and prohibition work?
Certiorari commonly concerns judicial review that quashes a legally defective decision of a court, tribunal or other authority exercising relevant powers. Prohibition restrains an inferior court or tribunal from continuing proceedings outside lawful jurisdiction. Their application depends on the body, stage of proceedings and defect alleged. Modern constitutional practice also uses directions and orders suited to the facts rather than relying only on historical labels.
Writ review is not generally a full appeal on every factual disagreement. Jurisdictional error, breach of natural justice or a legally impermissible decision may justify intervention, but the precise standard matters. Bring the initiating notice, pleadings, order sheets and challenged decision. Identify whether an appeal or revision is available and whether it can adequately address the issue. A litigant who simply wants evidence reassessed may need the statutory appellate forum rather than a writ petition framed as though every mistaken finding amounts to a jurisdictional failure.
What is a writ of quo warranto?
Quo warranto examines the legal authority by which a person occupies a public office. It can address appointment contrary to binding eligibility requirements or other applicable legal conditions. The concern is lawful occupancy of the office, not a general assessment of whether another candidate would be more impressive. The office and the rule allegedly violated must be identified precisely.
Standing for this remedy differs from a conventional personal service dispute, but that does not make it a vehicle for unsupported political allegations or personal rivalry. Obtain the governing statute, qualifications, appointment notification and reliable material showing non-compliance. A disputed interpretation may need careful legal assessment. Do not confuse a public office with every job in an organisation that receives some government support. The institutional status and nature of the position matter. If the real issue is your own recruitment rejection, ordinary service remedies may be more appropriate than labelling the case quo warranto.
Must you use a statutory appeal before filing a writ?
High Courts ordinarily expect an effective alternative statutory remedy to be used, but this is a rule of judicial restraint rather than an absolute absence of constitutional power. Whirlpool Corporation v Registrar of Trade Marks (1998) is a leading authority discussing recognised situations for intervention, including fundamental rights, natural justice and jurisdictional concerns. The facts must genuinely support the exception invoked.
Do not let an appeal deadline expire while assuming that adding an equality claim guarantees a writ hearing. Show the available remedy, its powers and why it cannot adequately address the particular issue if that is your position. An inconvenient remedy is not necessarily an ineffective one. Statutory tribunals may also have an important role in specialised fields. L. Chandra Kumar v Union of India (1997) explains the constitutional significance of judicial review while addressing tribunals. The right route depends on the legislation and procedural history, not merely the litigant’s preferred forum.
What documents and parties does a writ petition need?
Prepare a chronology, the disputed order, relevant rules, representations and proof of receipt. Include material correspondence in full and explain missing records honestly. The petition ordinarily needs verified pleadings and supporting documents in the form required by the court’s rules. Local filing requirements, translations, indexing and affidavits should be checked rather than guessed from an unrelated online template.
Identify the authority responsible for the decision and any people whose rights would be affected by the requested order. In a recruitment challenge, selected candidates may need to be joined; in an admission dispute, the institution and relevant regulator may matter. Non-joinder can obstruct effective relief. Disclose previous litigation and adverse orders, including applications that were withdrawn. A petition should separate final relief from interim protection and state each request clearly. Concise, accurate material is more valuable than attaching hundreds of pages without explaining how they support the alleged legal wrong.
How do urgent interim orders and PIL petitions work?
Interim relief protects the position while the case is pending. Courts assess considerations such as the apparent case, practical prejudice and the consequences of granting or refusing protection. Filing a petition does not itself stay an order. If a deadline, demolition or detention requires immediate attention, communicate the actual urgency and seek a specific order supported by documents.
Public interest litigation serves genuine public concerns, including situations where affected people cannot effectively approach the court. It is not a substitute for an ordinary personal service dispute or a means of concealing private commercial interests. Applicants must disclose their connection and reliable factual basis. Publicity does not prove urgency or public interest. Seek the affected community’s perspective and protect identifying information where necessary. A narrowly framed direction that an authority perform a defined duty may be more effective than a sweeping demand that the court supervise every aspect of an institution indefinitely.
What should you expect after a writ order?
Read the operative directions, time limits and conditions carefully. An order to consider a representation is not necessarily an order granting the underlying benefit. Supply any required documents and retain evidence of compliance. If the authority makes a fresh reasoned decision against you, assess that decision on its own terms rather than automatically treating it as disobedience.
Where an order is not followed, an advocate can advise on implementation, clarification or contempt proceedings as appropriate. Contempt is not a general second appeal or an automatic punishment for every disagreement about an order’s meaning. Appeals and review also have distinct legal requirements and deadlines. Supreme Court practice ordinarily involves an Advocate-on-Record unless the applicable party-in-person procedure is followed. Eligible people can seek legal services assistance. Throughout the process, realistic advice about the court’s powers and the limits of the requested remedy is more useful than a promise that a constitutional petition guarantees immediate success.
Frequently asked questions
Can I approach the Supreme Court for any legal right?
Article 32 concerns enforcement of fundamental rights, not every statutory or contractual entitlement. Article 226 has wider subject matter, but High Court review also has limits. Identify the right, respondent and available remedy first. A statutory appeal may be the appropriate starting point even where the dispute involves a public authority.
Can a family member seek habeas corpus?
Yes, a suitable applicant can approach the court where the confined person cannot do so personally. Give reliable details about the suspected detention and responsible persons. The remedy protects the detained person’s liberty. It does not give relatives a right to control a competent adult who voluntarily chooses to live elsewhere.
Does filing a writ petition automatically stop government action?
No. Protection requires an express interim or final order. Clearly state the impending action, date and risk of irreversible harm. Preserve proof of urgency and ask for tailored relief. Continue to comply with lawful requirements unless a court has suspended them or your adviser identifies another lawful basis for not doing so.
Is there one fixed limitation period for all writ petitions?
There is no single universal filing period covering every constitutional writ claim, but delay and laches can defeat relief. Statutory remedies have their own deadlines. The nature of the right, explanation for delay and effect on others matter. Seek advice promptly rather than treating the absence of one general period as permission to wait indefinitely.
Can I file a writ against a private school or company?
It depends on the institution, legal duty and challenged action. Article 226 may reach a private body performing a public duty, but not every private dispute is suitable. Statutory, consumer, employment or civil remedies may apply. Obtain the governing documents and explain the public duty instead of relying only on the organisation’s size or visibility.
Can legal aid cover constitutional proceedings?
Eligible applicants may seek assistance through the relevant legal services authority, including the appropriate High Court or Supreme Court legal services institution. Bring the order, chronology and details of earlier cases. Eligibility and merits are assessed under the applicable framework. Legal aid does not remove court rules or guarantee interim relief.
