Quick answer

In Joseph Shine v Union of India (2018), the Supreme Court struck down IPC section 497, making adultery no longer a standalone criminal offence. Adultery can still have consequences under applicable matrimonial law, including divorce. Allegations require evidence, and effects on maintenance depend on the particular statute and facts.

What did Section 497 criminalise before Joseph Shine?

IPC section 497 created an adultery offence structured around a man having sexual intercourse with another man’s wife without that husband’s consent or connivance, where the conduct did not amount to rape. The married woman was not punishable as an abettor. The offence did not treat spouses as equal legal persons.

Its design reflected an unequal understanding of marriage. A husband’s consent could determine whether the criminal offence existed, while the wife lacked an equivalent position in the statutory framework. The criminal provision therefore did more than express disapproval of infidelity: it embedded a gendered structure of control.

In Joseph Shine v Union of India (2018), a five-judge Constitution Bench unanimously struck down section 497. The Court also invalidated the connected procedural provision to the relevant extent. Since that ruling, consensual adultery is not a standalone criminal offence under the general penal law.

Why did the Supreme Court strike the provision down?

The Court examined constitutional equality, non-discrimination, dignity and autonomy. Marriage does not turn a woman into the property of her husband or erase her independent legal identity. A criminal law that rests on such assumptions cannot be justified merely because it has existed for a long time.

The judgment also distinguished private marital wrongs from conduct that warrants criminal punishment. Rejecting imprisonment for adultery did not require the Court to celebrate betrayal or deny the pain it causes. Constitutional limits on punishment can coexist with civil consequences for the breakdown of marital obligations.

This distinction is especially important when a relationship has become emotionally distressing. The law does not promise a criminal prosecution for every serious personal wrong. It may instead provide remedies through divorce, financial orders or other appropriate proceedings, depending on the particular conduct and governing legislation.

Can adultery still be a ground for divorce?

Yes. Under several matrimonial statutes, adultery remains a ground for divorce. The applicable test depends on the law governing the marriage. For example, the Hindu Marriage Act addresses voluntary sexual intercourse with a person other than the spouse after solemnisation. Other marriage laws must be checked separately rather than assumed to use identical language.

A divorce decree is not automatic because someone makes an allegation. The petitioner must plead and prove the legally relevant facts. Matrimonial proceedings generally apply the civil standard of proof, but the seriousness of an allegation makes reliable evidence important. Courts do not decide solely on suspicion, anger or community gossip.

Adultery and cruelty are also distinct concepts. Messages, humiliation or another relationship may be relevant to a cruelty allegation in some circumstances even where the statutory ground of adultery is not established. A lawyer should frame the case around provable facts rather than adding every available legal label.

What evidence can be used without breaking the law?

Relevant material may include admissions, lawful communications and circumstantial evidence that supports the alleged relationship. Direct eyewitness evidence of sexual conduct is not ordinarily something a spouse can realistically obtain. Still, friendship, a photograph or frequent communication does not necessarily prove adultery without further context.

Preserve originals and maintain a clear account of how you obtained each item. The BSA, 2023 [Indian Evidence Act, 1872] governs evidence for proceedings to which it applies, including requirements relevant to electronic records. Saved older proceedings may follow the previous framework. Admissibility and weight need case-specific advice.

Do not hack accounts, install spyware, impersonate someone or distribute intimate images. Marriage does not grant unrestricted access to another person’s devices or body. Unlawful collection and public exposure may create separate legal risks and can increase harm to children or other people who are not parties to the dispute.

Does adultery automatically stop maintenance or decide custody?

No single rule answers every financial claim. Under BNSS section 144 [CrPC section 125], a wife living in adultery faces a specific statutory disqualification. Courts distinguish that expression from assuming that every alleged isolated incident establishes it. The provision must be applied on evidence, not merely on an accusation.

Other maintenance and alimony provisions have their own wording, including rules that may consider conduct. The applicant’s status, governing marriage law, existing orders and stage of proceedings all matter. Neither spouse should stop obeying a court order simply because an allegation has been made; seek modification or other appropriate judicial relief.

Child custody is determined primarily by the child’s welfare under the applicable legal framework. A parent’s alleged adultery does not automatically prove that the parent is unsafe or incapable of care. Courts need relevant information about caregiving, stability and the child’s needs, not an attempt to punish a spouse through the child.

How much proof does a divorce court need for adultery?

A matrimonial court generally applies the civil standard of preponderance of probabilities, not the criminal standard of proof beyond reasonable doubt. Nevertheless, an allegation of adultery needs cogent evidence; suspicion, friendship or frequent communication alone does not necessarily establish voluntary sexual intercourse. Explain precisely what each document proves and what remains an inference. A lawyer can assess whether the overall circumstances support the pleaded ground without turning ordinary social contact into an accusation of sexual misconduct.

For example, travel records may establish that two people visited the same city, but not that they stayed together or had a sexual relationship. A message may be affectionate yet ambiguous when separated from its conversation. Present complete context and avoid overstating conclusions. Under applicable matrimonial law, conduct that falls short of proving adultery might still be relevant to another pleaded ground, but that possibility requires separate legal analysis rather than an automatic relabelling of weak evidence.

Should you name the alleged partner in a divorce petition?

Check the matrimonial rules applicable to the particular court before naming another person as a party. Some procedural rules address joining an alleged adulterer and circumstances in which that requirement may be dispensed with. There is no safe nationwide answer based only on a social media template. Provide your lawyer with reliable identifying information, explain what is genuinely unknown, and discuss the consequences of adding someone who will receive the allegations and may contest them.

Avoid circulating pleadings among colleagues, relatives or online groups to pressure either person. Under the Hindu Marriage Act, proceedings are held in camera and publication is restricted, subject to the statutory exception. Other applicable procedures also require attention to privacy. A document filed for adjudication is not a licence for a publicity campaign. Ask how addresses, sensitive exhibits and intimate communications should be submitted and accessed without needlessly exposing children or unrelated third parties.

What if spouses reconcile after an alleged affair?

Reconciliation can affect a later petition under the Hindu Marriage Act because the court considers whether adultery has been condoned. Condonation involves more than merely continuing to share an address through financial necessity; its application depends on the facts, including forgiveness and restoration of the marital relationship. Tell your lawyer about counselling, resumed cohabitation and subsequent events. Concealing an attempted reconciliation may create avoidable contradictions when the other spouse produces messages showing what actually happened.

Before signing a reconciliation agreement, separate practical promises from legal conclusions. An agreement about finances, counselling or boundaries does not itself grant a divorce if a promise is broken. Nor can spouses privately create a criminal adultery offence that Parliament has not enacted. If reconciliation fails, preserve an accurate chronology and obtain advice about available grounds and relevant later conduct.

Frequently asked questions

Can I file an FIR only because my spouse had an affair?

An affair alone does not support prosecution under the invalidated IPC section 497. If there is separate conduct such as violence or criminal intimidation, describe that accurately and seek advice on the applicable offence. Do not add allegations simply to convert a matrimonial dispute into a criminal case; each offence requires its own factual basis.

Did Joseph Shine remove adultery as a divorce ground?

No. Joseph Shine v Union of India (2018) concerned criminal liability. Adultery remains relevant under applicable matrimonial legislation, including as a divorce ground under several statutes. Which provision applies depends on the marriage and the facts. Decriminalisation is not the same as removing every civil consequence of marital infidelity.

Are screenshots enough to prove adultery?

Not automatically. Courts consider authenticity, context, lawful proof and what the material actually shows. A screenshot may support part of a case without establishing sexual intercourse or the relevant statutory ground. Preserve originals and ask a lawyer about electronic-record requirements before relying on isolated, edited or anonymously supplied images.

Can I refuse all maintenance after discovering an affair?

Do not disregard an existing order. Different maintenance provisions use different tests, and allegations require proof. Under the general summary maintenance provision, living in adultery has a specific legal significance, but it is not established by suspicion alone. Apply to the appropriate court for any modification or cancellation that the facts justify.

Is mutual-consent divorce possible after an adultery dispute?

Yes, if both spouses freely agree and satisfy the requirements of the applicable marriage law. A settlement can address financial matters, property and arrangements concerning children, subject to legal scrutiny. Neither spouse must obtain a criminal finding of adultery first. Obtain advice before signing releases, especially where existing orders or children’s rights are involved.
