Money recovery or cheque bounce

You can send a legal notice, file a civil suit for recovery, use summary procedure for written debts, or file a cheque-bounce complaint if a cheque was dishonoured.

Timing matters

Civil money claims are generally subject to three years, but the starting date and effect of acknowledgements or part-payments need review. For cheque dishonour, the payee must give demand notice within 30 days of receiving bank dishonour information; the drawer has 15 days from notice receipt to pay. Check the separate complaint-filing limit.

Immediate steps

  1. 1

Gather proof of the loan or payment

  2. 2

Send a written demand or legal notice

  3. 3

If a cheque bounced, send notice within 30 days of the bank memo

What not to do

  • Do not threaten or harass the debtor
  • Do not let the limitation period run out
  • Do not part with original promissory notes
