How to use the Property Legal Analyser

Property disputes are the largest category of civil litigation in India. Most of them begin with a missing document, an unregistered agreement, or a family member who assumes a share without a partition. This tool helps you understand where you stand before you spend money on a lawyer or a court case. It organises your facts the way an experienced property advocate would when writing a preliminary opinion: what the problem is, which law governs it, how strong or weak your position looks, what documents decide the matter, and which forum gives the fastest realistic remedy.

1. Choose the right issue type

A title check before purchase asks different questions from a partition suit or a RERA complaint. Pick the closest match. For a title check, the opinion focuses on the chain of title for at least 30 years, the encumbrance certificate, mutation entries, approved layout and building plans, and whether earlier transfers were registered conveyances. The Supreme Court in Suraj Lamp & Industries v. State of Haryana held that sale agreements, general powers of attorney and wills are not modes of transferring immovable property, so a title resting only on such documents is a serious risk.

2. Describe the facts honestly and in order

Say who owned the property, how it was acquired (purchase, inheritance, gift, allotment), what changed, and who is in possession today. Include years even if approximate. Limitation periods under the Limitation Act, 1963 depend on these dates: a suit for possession based on title generally has 12 years under Article 65, while cancelling a deed or seeking specific performance usually has only 3 years. The tool shows these periods from fixed rules, not from AI guesses.

3. List the documents you hold

Sale deed, parent documents, encumbrance certificate, patta/khata/7-12 extract, property tax receipts, occupancy and completion certificates, builder-buyer agreement, will, gift deed, legal heir or succession certificate, and bank sanction letters all change the analysis. If you do not have a document, say so; the opinion will tell you which office issues it.

4. Read the risk rating and the solution paths together

A high-risk rating does not mean you will lose; it means the outcome depends on proof or on a contested point of law. The solution paths compare a legal notice, mediation under the Mediation Act 2023, a civil suit, a RERA complaint, a consumer commission complaint, a revenue court application, or a criminal complaint for forgery or cheating under the Bharatiya Nyaya Sanhita. Many family property disputes are settled faster by a registered family settlement or partition deed than by a decade-long suit.

Common property situations it handles

  • Daughters’ share in ancestral property: after Vineeta Sharma v. Rakesh Sharma (2020), daughters are coparceners by birth in Hindu joint family property.
  • Builder delay: Section 18 of RERA lets an allottee choose refund with interest or interest for every month of delay, as confirmed in Newtech Promoters v. State of U.P.
  • Bank auction under SARFAESI: a borrower or affected person must approach the Debts Recovery Tribunal under Section 17 within 45 days of the measure.
  • Encroachment by a neighbour: survey and demarcation through the revenue department, followed by a suit for injunction and possession if needed.
  • Tenant not vacating: eviction depends on your State rent control law or the Model Tenancy framework adopted by the State.

What the tool will not do

It will not invent case law, quote stamp duty rates, guarantee outcomes or replace a document examination. Stamp duty and registration charges differ by State and change often; check your State Inspector General of Registration portal. When money, family relationships or limitation deadlines are at stake, take the opinion to an enrolled advocate and verify their enrolment with the State Bar Council.

Frequently asked questions

Is this a legal opinion from an advocate?

No. It is preliminary legal information generated by AI from the facts you type, written in the structure an experienced property advocate uses. A binding title or legal opinion must be signed by an enrolled advocate after examining original documents.

How accurate are the laws and judgments shown?

The tool can only cite statutes from a fixed list of Indian property laws and Supreme Court judgments that LawLine has checked. Anything else the AI suggests is removed before you see it. Section numbers should still be read in the official text on India Code.

Where do the limitation periods come from?

Directly from the Schedule to the Limitation Act, 1963 (and Section 17 SARFAESI / Section 69 Consumer Protection Act) stored in fixed rules. The AI does not calculate them. Exceptions such as acknowledgment, fraud discovery or disability can change the date.

Does it cover my State?

Central laws apply everywhere. Stamp duty, registration fees, rent control, mutation and revenue procedures are State-specific; the opinion flags these and you should confirm with your State IGR or revenue portal.

Is my information stored?

Your facts are sent to the AI to generate the opinion and are not saved in a LawLine database. Avoid entering Aadhaar numbers or bank details.

Most property disputes start with an unchecked title or an unregistered document. You can property title verification, compare options through our sale deed registration, or go straight to find a verified advocate. Always cross-check rules on the e-Courts case status services and the Department of Land Resources before you act.
