Property dispute or purchase

Common issues are encroachment, family partition, a seller who will not register, or a forged document. Remedies include injunction, partition, specific performance or cancellation suits.

Timing matters

Different remedies have different starting dates and limits. Specific performance is generally three years under Article 54; title-based possession generally twelve years under Article 65. Fraud, knowledge, adverse possession and other exceptions need individual review.

Immediate steps

  1. 1

Collect the title chain, encumbrance record and relevant land/revenue records

  2. 2

For a purchase, have title, possession, approvals and pending proceedings checked before paying or signing

  3. 3

For a dispute, preserve evidence and ask an advocate whether notice or urgent interim relief is appropriate

What not to do

  • Do not sign new documents or blank papers
  • Do not take possession by force
  • Do not pay full consideration before checking title
